Welcome to Empower GRIT.

These Terms of Service (“Terms”) govern your access to and use of the Empower GRIT website, community, general resources, products, services, and other experiences provided by Empower GRIT, LLC (“Empower GRIT,” “we,” “us,” or “our”).

By accessing or using an Empower GRIT service to which these Terms apply, creating an account, purchasing a product or service, or otherwise agreeing to these Terms, you agree to be bound by them.

If you do not agree to these Terms, please do not use the applicable services.

Certain Empower GRIT products or services may have additional terms, disclosures, agreements, or consent requirements. When additional terms apply, they will be presented in connection with that product or service.

1. Eligibility

Empower GRIT's general services and community are intended for individuals age 18 and older unless a particular product or experience expressly states otherwise.

By creating an account or using a service restricted to adults, you represent that you are at least 18 years old and legally capable of agreeing to these Terms.

2. About Empower GRIT

Empower GRIT provides educational resources, self-discovery tools, pattern-recognition experiences, community opportunities, and related products and services designed to help individuals better understand their experiences and make informed, intentional choices.

Empower GRIT resources may incorporate information and perspectives from multiple disciplines or frameworks.

Unless expressly stated otherwise, Empower GRIT's general resources and services are educational and informational in nature.

3. Not Medical or Other Professional Advice

Empower GRIT does not provide medical diagnosis or treatment, psychotherapy, legal advice, financial advice, or other licensed professional services through its general educational resources.

Health, wellness, lifestyle, or other information provided through Empower GRIT is intended to support education, self-discovery, pattern recognition, and more informed conversations with appropriately qualified professionals.

Information provided through Empower GRIT should not be used as a substitute for individualized professional care, diagnosis, or treatment.

If you have concerns about your physical or mental health, seek guidance from an appropriately qualified healthcare professional. If you believe you are experiencing an emergency, contact appropriate emergency services.

4. Accounts and Registration

Some Empower GRIT services may require registration or an account.

When registering, you agree to provide information that is accurate to the best of your knowledge and to maintain the security of your account credentials.

You are responsible for activity occurring through your account unless unauthorized access has been reported to the applicable platform or Empower GRIT.

Empower GRIT may use third-party platforms to provide certain services.

Where Empower GRIT offers to facilitate creation or setup of an account with a third-party platform, such as GoKollab, we will request your authorization before providing information for that purpose.

Use of a third-party platform is also subject to that platform's applicable terms and privacy practices.

5. Empower GRIT Community

Empower GRIT may provide online community spaces for discussion, learning, reflection, and shared experiences.

By participating, you agree to interact respectfully and refrain from conduct that:

• Harasses, threatens, intimidates, or abuses another person

• Discriminates against or targets individuals or groups

• Violates another person's privacy

• Is defamatory, fraudulent, deceptive, obscene, or unlawful

• Infringes intellectual property or other legal rights

• Distributes spam, unauthorized advertising, or solicitations

• Attempts to interfere with the security or operation of the community

• Uses community access primarily to collect member information, solicit members, or promote unrelated commercial activities

Empower GRIT may moderate community spaces and may remove content or restrict, suspend, or terminate access when reasonably necessary to enforce these Terms, protect members, maintain community integrity, or comply with law.

6. Member-Generated Content

You retain ownership of original content you create and share through Empower GRIT community spaces.

You are responsible for ensuring that you have the right to share content you post.

By posting content within an Empower GRIT community, you grant Empower GRIT a limited, non-exclusive, royalty-free license to host, store, display, reproduce, and technically process that content only as reasonably necessary to operate, administer, moderate, maintain, or improve the community and related service.

This operational license does not, by itself, give Empower GRIT permission to use your personal story, name, image, testimonial, or identifiable community contribution in advertising, promotional materials, case studies, or public-facing marketing.

Where Empower GRIT wishes to use identifiable member content for those purposes, separate permission may be requested.

7. Member Privacy

Community spaces are shared environments.

Information you post in member-visible areas may be viewed by other members. You are responsible for deciding what personal information you choose to share in those spaces.

You agree not to copy, distribute, publish, or commercially exploit another member's personal story, images, posts, private information, or community contributions without appropriate permission.

Empower GRIT cannot guarantee that other members will comply with community rules and is not responsible for unauthorized actions taken independently by other users to the maximum extent permitted by law.

Information submitted privately through a separate Empower GRIT product or service is governed by the applicable privacy and consent terms and is not considered community content merely because you are also a community member.

8. Empower GRIT Intellectual Property

Unless otherwise stated, Empower GRIT, LLC or its licensors own the intellectual property rights associated with Empower GRIT materials.

These may include, without limitation:

• The Empower GRIT name, branding, and logos

• Educational materials

• Written content

• Journals and journal content

• Discovery questions and question structures

• Assessments and frameworks

• Reports and report formats

• Graphics and visual materials

• Videos and digital resources

• Exercises and discovery experiences

• Proprietary methodologies, systems, organization, and original expressions of those methodologies

Purchasing or receiving access to an Empower GRIT product does not transfer ownership of Empower GRIT intellectual property.

Unless expressly authorized, Empower GRIT materials are provided for your personal, non-commercial use.

You may not reproduce, republish, sell, license, distribute, commercially exploit, or create unauthorized copies of protected Empower GRIT materials except as permitted by applicable law or with written authorization from Empower GRIT.

Nothing in these Terms is intended to restrict rights that cannot legally be restricted, including applicable rights under copyright law.

9. Third-Party Content and Resources

Empower GRIT may reference or link to third-party articles, research, websites, videos, books, products, practitioners, tools, platforms, or other resources.

References to third-party resources are provided for educational or informational purposes and do not necessarily constitute endorsement.

Empower GRIT does not control third-party content, availability, privacy practices, accuracy, products, services, or policies and is not responsible for them.

Your interaction with a third party is subject to the terms and policies applicable to that third party.

10. AI-Assisted Information

Some Empower GRIT products or services may use artificial intelligence or other technology-assisted tools to organize information, identify potential patterns, summarize information, translate complex information, or generate educational insights.

AI systems have limitations and may produce inaccurate, incomplete, outdated, or inappropriate information.

AI-generated or AI-assisted information provided through Empower GRIT should therefore be considered in context and should not be treated as a medical diagnosis, professional determination, or guarantee of accuracy or outcome.

Additional disclosures or consent requirements may apply when AI is used in connection with particular services or categories of information.

11. Products, Purchases, and Paid Services

Empower GRIT may offer physical products, digital resources, memberships, reports, educational experiences, or other paid services.

Prices, features, included services, delivery terms, cancellation terms, and refund policies may vary by offering and will be described at or before purchase where applicable.

You agree to provide accurate information necessary to complete a transaction.

Payments may be processed by third-party payment providers and may also be subject to their terms.

Nothing in these Terms guarantees that a particular product, feature, community, service, or price will remain available indefinitely.

12. Specialized Products and Additional Consent

Certain Empower GRIT services may involve information or experiences that require additional disclosures or agreements.

For example, services involving health or wellness-related information may require separate informed consent, privacy disclosures, or information-handling terms.

Where additional terms apply, participation in that service may require acceptance of those additional terms.

The general acceptance of these Terms does not replace consent that Empower GRIT expressly requires for a specialized service.

13. Educational Outcomes and Personal Responsibility

People may experience Empower GRIT resources differently.

Empower GRIT does not guarantee any particular personal, professional, financial, health, wellness, or other outcome from using its products or services.

You remain responsible for your decisions, actions, and use of information obtained through Empower GRIT.

Where information could materially affect your health, finances, legal rights, or another area requiring professional expertise, you should consult an appropriately qualified professional.

14. Availability and Changes to Services

We may add, modify, improve, suspend, or discontinue products, services, community features, or other functionality as Empower GRIT evolves.

We do not guarantee uninterrupted or error-free availability of the website, community, or third-party platforms.

Where changes materially affect a paid product or service already purchased, we will address them in accordance with applicable purchase terms and law.

15. Suspension and Termination

Empower GRIT may restrict, suspend, or terminate access when reasonably necessary because of:

• Violation of these Terms

• Harmful or abusive community behavior

• Fraud or suspected unlawful activity

• Security concerns

• Misuse of Empower GRIT intellectual property

• Nonpayment where payment is required

• Legal or regulatory requirements

• Conduct that materially threatens the integrity or operation of Empower GRIT services

Where reasonable under the circumstances, we may provide notice or an opportunity to address the issue.

Certain obligations—including intellectual property protections and provisions that by their nature should survive termination—remain applicable after access ends.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Empower GRIT products, services, resources, community spaces, and information are provided on an “as is” and “as available” basis.

Empower GRIT does not warrant that services will always be uninterrupted, error-free, completely secure, or that all information will be accurate, complete, or current.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Empower GRIT, LLC and its owners, employees, contractors, or agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to your use of Empower GRIT services.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

18. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, or expenses arising from content you unlawfully submit, your material violation of these Terms, or your infringement of another person's rights.

19. Privacy

Use of Empower GRIT services is also subject to the Empower GRIT Privacy Policy.

Additional privacy or consent terms may apply to particular products or services.

Third-party platforms used in connection with Empower GRIT maintain their own privacy practices.

20. Changes to These Terms

Empower GRIT may update these Terms as our products, services, technology, or legal requirements evolve.

When changes are made, the “Last Updated” date will be revised.

When appropriate or required by law, we may provide additional notice of material changes.

Continued use after revised Terms become effective may constitute acceptance where permitted by applicable law.

21. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.

22. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

23. Entire Agreement

These Terms, together with the Empower GRIT Privacy Policy and any additional terms or agreements applicable to a particular product or service, constitute the applicable agreement between you and Empower GRIT regarding the services covered by them.
